PHOTOS: MARK HAYS By Mark Hays The use of electric bicycles in the City of Phoenix has led to concerns among local legislators, who have implemented new rules on their use. Several laws were passed that could lead to citations issued to e-bike riders who commit violations. “E-bikes are a fantastic alternative form of transportation, but – as with all new technology – there are new problems, which were never a consideration before,” Phoenix Community Action Officer Jared Sherman said. “Due to this, Phoenix City Council passed PCC 36-500-513, which pertain to the safety and regulation of e-bikes on Phoenix streets.” Regulations include: Riders must ride e-bikes on the road or in bike lanes. The City of Phoenix prohibits anyone younger than 16 from operating one. They are also forbidden from riding on sidewalks. If a rider needs to make a turn prohibited for vehicles, they should dismount and walk e-bikes on the sidewalk. How fast you can drive them depends on how fast is safe, given the circumstances. “A person shall control the speed of a motorized electric bicycle as necessary to avoid colliding with any object, person, vehicle or other conveyance on, entering or adjacent to the roadway in compliance with legal requirements and the duty of all persons to exercise reasonable care for the protection of others,” reads Sec. 36-500 of the Phoenix Municipal Code. Another thing e-bike users should be aware of is that they are required to yield to all vehicles, non-electric bicycles and pedestrians. They must obey all vehicle traffic rules whenever they are on roadways or in bike lanes. The code extends to safety features, which must be in working order. The Phoenix Police Department wants to remind all bike riders to be safe, wear a helmet, when riding at night use a white headlight that can be seen from 500 feet away and a rear reflector visible from 50 to 300 feet, and avoid wearing dark clothing. When parking a bicycle, riders should take caution to ensure that they are not obstructing traffic or impeding pedestrians. To do so, riders must stay clear of the intersection of two sidewalks, as well as restaurants and curb ramps within 10 feet, sidewalks with less than two feet for pedestrians to pass safely, and loading zones. Also, cyclists should obey any signs that prohibit the use of bicycles in certain areas, such as bus stops. Any prohibitions on regular bicycles also applies to e-bikes. If your bike is removed, the city will attempt to contact you and inform the public about unclaimed e-bikes. The city may implement fines to recover the cost if an e-bike is removed from a prohibited area. “The laws are there to protect those riding e-bikes, as well as the communities in which they are being used,” Sherman said. “It is my hope that the effect these laws have on the Arcadia community are positive ones that ensure the safety of every community member.” “The ACMNA has always been an advocate for the safety of our residents. Now that city codes have caught up with technological advancements, we fully support these laws and believe it supports a safer environment on our roadways,” ACMNA President Michael Phillips said.
