Hasebe If I want to eat at a new restaurant, find a trustworthy mechanic or grab a drink with friends, I do some research first. Like many in my generation, one of the first things I do before trying a new business is search Yelp, Urbanspoon, TripAdvisor or the myriad other websites and apps that allow consumers to provide their opinions on a wide range of businesses. As the number of consumers who use online reviews to make their decisions about where to shop, eat or pay for services grows, businesses – especially smaller ones – have become well aware of the “Yelp Factor” and how social media can drive sales. Recent studies on the Yelp Factor have shown that each rating star added to a Yelp restaurant review had anywhere between a 5 and 9 percent effect on the businesses’ revenues. While a positive review can drive customers to a business and help their reputation, a negative review can have the opposite effect. As a result, in recent years, there have been a growing number of lawsuits filed by businesses against individuals who have submitted poor reviews. The most common cause of action in these types of lawsuits is for defamation. Freedom of speech, courts have ruled, does not extend to defamation. In other words, while consumers have the right to use review sites to express their opinions about their experiences with businesses, the opinions and any facts provided must be true, or substantially true. Under Arizona law, in order to prove a claim for defamation, a business is required to show that the reviewer (a) knew that the statement is false and is defamatory, (b) acted in reckless disregard of these matters, or (c) acted negligently in failing to ascertain them. As a general rule, when leaving a negative review about a business, don’t exaggerate or lie. While truth is a defense to defamation, you may have to prove that any claims made in your review were true, so keep any factual statements truthful and straightforward. Additionally, a reviewer’s opinion is more easily defendable on First Amendment ground than factual claims. In other words, it’s better to say, “The experience at this business left me feeling cheated” than “The shop owner stole my money without providing the services I paid for.” Or say, “In my opinion, the service and cleanliness of the restaurant was very poor,” rather than “There was a bug in my food.” To summarize: If you stick to the truth and don’t make exaggerated factual statements that are hard to prove, you can feel free to submit negative reviews without risking a potential claim for defamation. — Johnathan T.
