After several years on the bench, judges are then subject to retention elections in which voters decide whether to “re-elect” a given judge. Prior to the retention elections, voters receive judicial performance evaluations for each judge. Proposition 115 does not purport to remove merit as a factor in judicial selection. However, if approved by voters, it would implement the following changes to the process: The nominating commissions will be required to recommend at least eight (instead of three) applicants to the governor. There will be no limit on the number of recommended applicants who can be from the same political party. The governor will directly appoint four of the attorney members of each nominating commission; one will be appointed by the state bar. The non-attorney members of the nominating commissions will be appointed by the governor without the requirement of a separate committee recommendation or public notice or solicitation. Prior to retention elections , a joint legislative committee will be authorized to meet and take testimony concerning any of the judges who are up for retention. The legal community is divided over Proposition 115. Some believe the proposed changes will improve the process by giving the governor more choice and control. Others maintain the governor’s increased control will infringe on judicial independence and will result in the appointment of less quali fi ed applicants.
