Page 16 September 2012 Proposition would alter judge choice By Jennifer A. Cranston This fall, Arizona voters will have a lot of decisions to make, including whether to change the process of judicial selection. Ballot Proposition 115 seeks to amend provisions of the Arizona Constitution regarding the selection and retention of appellate judges statewide and trial court judges in Maricopa and Pima counties. The current system is known as merit selection, and is intended to appoint judges based on their quali fi cations. Under this system, the governor appoints trial and appellate court judges from a list of at least three applicants recommended by a nominating commission. Only two of these recommended applicants may be members of the same political party. There are three nominating commissions – one for appellate judges, one for Maricopa County trial court judges and one for Pima County trial court judges. Each nominating commission is comprised of fi ve attorneys and 10 non- attorneys. The attorney members are recommended by the Arizona State Bar and appointed by the governor.
