Page 6 August 2011 This month’s report from Arcadia lawyer Bob Jones A power of attorney is a document with serious legal signi fi cance. In general terms, it is the legal authorization of an individual or entity to act on behalf of someone. Powers of Attorney fall into two categories – business and health care. Under a health-care power of attorney, the person giving or granting the power of attorney designates an agent, person, receiving the authorization. The agent is given the authority to make health-care decisions on behalf of the principal as provided for in the power of attorney. The power of attorney can be broad or very limited as the principal chooses. Normally, with a health-care power of attorney, the principal retains the right to continue to make health-care decisions as long as he is able to do so. There are speci fi c laws in Arizona that cover the execution and signing, of the power of attorney as well as its content. Because of the importance in making proper health-care decisions, providing authorization for the release of medical records and deciding on who the agent should be, careful consideration should be given the matter, with the assistance of your attorney. A business power of attorney is used for purposes of authorizing an agent to make business decisions. Business powers of attorney can be special powers of attorney or general powers of attorney. Typically, a special power of attorney would be used to authorize a speci fi c transaction such as the sale of a piece of real estate or access to a bank account. A general power of attorney is exactly that, it would be a grant of general authority for an agent to act on behalf of the principal for the matters covered in the power of attorney. It should be noted that unless a transaction is clearly provided for in the power of attorney, it may not be accepted. Many forms in circulation are so general in their language that they may be rejected by fi nancial institutions, title companies, etc. This is a document that should be carefully drafted to make sure all authorized acts of the agent are clearly set forth. The law in Arizona has detailed provisions regarding whether an agent may bene fi t from the use of the power of attorney and if so, the execution requirements must be closely followed. A business power of attorney is often used in conjunction with an estate plan providing authorization to move assets from an individual’s name to that of the individual’s trust.
