Page 6 March 2011 This month’s report from Judge Sarkis In the majority of these monthly articles the Arcadia News has been gracious enough to let me write, I’ve discuss the entire Maricopa County Justice Court system. Focusing on the whole system keeps people informed and up to date on what the court community is doing to continuously improve the judicial process. In this month’s report, though, I would like to shed light on our local court, the Arcadia Biltmore Justice Court and what we accomplished during the past year. In 2010, the Arcadia Biltmore Court processed more than 9,000 cases that included driving under the in fl uence, criminal traf fi c, civil traf fi c (excluding photo enforcement), misdemeanor, small claims, eviction actions, orders of protection, injunctions against harassment, and various other civil and criminal violations. Additionally, this court handled more than 52,000 of the famous, or maybe infamous, civil traf fi c photo enforcement cases. Although the photo enforcement system is no longer in effect in Maricopa County, save for a few exceptions, the dedicated staff of this court worked tirelessly to process this, at one time, seemingly insurmountable number of cases. Upon combining the median percentages of these various case types, the Arcadia Biltmore Justice Court has a clearance rate of 98 percent. A courts’ clearance rate is calculated by dividing total case terminations by the total of new case fi lings. Essentially what this means is that this court has already processed from start to fi nish – either through an arraignment, pre-trial conference, bench trial or jury trial – 98 percent of the cases that were fi led in 2010. In the end, the large majority of people never are in court. I’ve also come to terms with the notion that no matter which side people fi nd themselves on in court – plaintiff, defendant, juror or victim – they most likely do not wish to be there. Rest assured that the Arcadia Biltmore Justice Court, along with the 25 other justice courts throughout Maricopa County, are doing their best to provide fair and speedy justice to all those that pass through our doors. Lastly, never forget that the courts are open to the public. It’s not unusual for local law students or curious citizens to stop in and listen to a few hearings, ask questions and pose concerns.
