THURSDAY NIGHTS SCOTTSDALEGALLERIES.COM Page 60 November 2015 By Alicia Morales The Tempe City Council passed an ordinance with a four to three vote on September 24, 2015 that has to do with cell phone usage and driving. “This legislation will help decrease deaths in auto accidents,” said Councilman David Schapira. “It is rare that an ordinance come before us that will literally save lives,” he said. The passing of the ordinance will help protect the youth-populated town, suggested Councilmen Kolby Granville. “We have a younger population, and we can try to protect all residents,” said Granville. Tempe City Council had a regular public meeting on Thursday to discuss several different resolutions, awards and ordinances. Section 55 of chapter 19 of the Tempe City Code will make it unlawful for any person to operate a motor vehicle while using an electronic device if it is distracting the driver and causing them to swerve the car. Councilman Joel Navarro said he was concerned on how tickets would be issued. He created a scenario for John Rush, the assistant chief of police of Tempe Police Department, questioning how the police will go about giving citations. “If we saw texting but no risky behavior, then we would not pull the car over” said Officer Rush. Rush said that if the car is swerving in their lane, then the driver would get pulled over. He said the police are going to treat it like a DUI and ask if the driver has been drinking. If the driver has not been drinking, then the police officer will ask the driver if they were on their phone if the officer did not see them using their mobile device, said Rush. The offender will be fined plus receive any penalty if an accident is caused. The first fine is $100 and the second is $250. Any incident following the first two offenses within a 24-month period is $500. Councilwoman Lauren Kuby asked Rush later in the meeting if an amendment could be made so that there is a warning for the first time the car is pulled over due to cell phone usage. According to Rush, that kind of request requires a public hearing. Earlier in the discussion, Tempe Mayor Mark Mitchell said Arizona is one of few states that does not have a statewide ban on using cell phones in the car. In order to get this law statewide, Councilman Schapira said cities of Arizona need to adopt this law and “pull the weight” to get it across the state of Arizona. “Hopefully this legislation will change the behavior of residents in Tempe,” Schapira said.
