After the hearing, which ended up being more like a full-blown trial, Judge Spicer eventually ruled there was not enough evidence to hold the defendants in custody. The grand jury later would accept Spicer’s decision and refuse to indict Holliday or the Earp brothers. I found it amusing that, much like today, the judge’s decision was widely ridiculed. After his decision, Spicer became fodder for the press. Newspapers such as the Tombstone Nugget and the Arizona Daily Star spoke poorly of his decision, jokes were made at his expense and death threats were made against him. After the dust settled, Judge Spicer didn’t seek reelection. Instead, he set out on a life of prospecting in Southern Arizona and later into Mexico. It’s said Spicer put all of his resources into a silver mining operation in Mexico that eventually went bust.
