BLI v. Bradley The second case involved the purchase of development property in New Mexico and an appraisal written for the buyer. The investors who funded the transaction claimed the appraisal overvalued the property by more than three times its actual value. In December, the Court of Appeals held that the appraiser could be sued by the investors even though the investors did not hire him. The court rejected the defendant appraiser’s argument that the expanded concept of duty approved in the Sage case should be limited to residential transactions. Instead, the appellate court held appraisers can owe duties to – and be sued by – anyone to whom the appraiser knows his client intends to supply the appraisal. Further, the appraiser does not need to know the speci fi c identity of the plaintiff who receives the appraisal; he can be sued by someone in a limited class of persons who the appraiser’s client intended to give a copy (i.e., lender, borrower, property owner or buyer). The Arizona Supreme Court has yet to weigh-in on this issue. So, for now, this expanded concept of duty and the additional lawsuits that may result are the current status of the law. Jennifer A.
