In all of last year, a total of just less than 10,000 cases led were led in this court. And, of course, I performed a few wedding ceremonies, as well. The longer the term, the greater the discount applied to the gift and therefore the tension lies in the decision of how long does the trustor conservatively believe he will live. The age of the trustor and a special federal interest rate set monthly also impact the discounted gift value. Once the trustor has reached a decision on the term, and the trust is formed and funded, the trustor has the retained right to continue to occupy and use the property contributed to the Qualied Personal Residence Trust for the term of the trust without any changes. I generally recommend the trust distribute to a separate trust for the residual beneciaries (usually children of the trustor), so they will have asset protection. If the trustor decides to continue living in the property contributed, normally following the expiration of the term, a lease-back arrangement can be arrived at. This article is by no means intended to cover all the technical requirements of a Qualied Personal Residence Trust, and this estate planning tool should only be pursued with the assistance of an experienced estate planner. The attractiveness of the Qualied Personal Residence Trust is that it allows taking advantage of a gift-tax exemption immediately without having to give up the right to use a primary residence or vacation home until a future date.
