Page 8 April 2012 This month’s report from Justice Steven Sarkis Landlord and tenant disputes, more commonly referred to as eviction actions, are one of the more prevalent cases throughout the justice courts. From inside the courtroom to out in the community, these cases can be dif fi cult. Eviction actions typically arise when tenants stop paying rent, fail to comply with their lease (i.e. having an unauthorized pet or occupant), or commit some type of crime on the property. Landlords can then fi le an eviction action in any local justice court. As a judge in the courtroom, eviction matters are challenging. It is hard to tell someone face to face they only have a few days to completely vacate their property. Some of these tenants have been in these properties for a very long time, but simply have fallen on hard times. However, the law is clear and it must be applied fairly and impartially. This is but one aspect of a judge’s job, yet in doing so I still try to be as compassionate and helpful as possible. In my court, information regarding community resources, such as fi nancial and housing assistance, is given to struggling individuals on a daily basis. And, as dif fi cult as these eviction actions are inside the courtroom, they are even more dif fi cult outside in the community. This is where the Maricopa County Constables come into play. Constables have a dif fi cult job. After a judge issues and signs an eviction order the constables are out in the community ensuring the evicted parties have indeed moved out. Constables perform a variety of duties, but carrying out evictions is likely the task they perform most. Since 2008, constable Carolyn Lane has been out in our community serving such eviction orders for the Arcadia Biltmore Justice Court. During the past few years, in addition to serving various other court orders, Lane has helped keep our community safe by carrying out thousands of these eviction orders.
