A power of attorney may be durable. If so, it endures incapacity, thereby allowing the agent to continue to act following the principal’s legal incapacity. If it is not durable, it lapses when the principal becomes incapacitated and the agent may no longer act under the power of attorney. The last, and many times one of the most overlooked, aspects of a power of attorney is that all powers of attorney are only valid during the life of the principal. At the death of the principal, the agent’s authority is legally canceled. Powers of attorney should only be given with a complete understanding of their legal effect.
