Page 10 June 2011 This month’s report from Justice Steven Sarkis In the Arcadia Biltmore Justice Court, cases involving animals are few and far between. This likely will change as a result of a law signed by Gov. Brewer in May. Until now cases involving animals have not been overly common in the Valley as a whole. Last year, Maricopa County Animal Care and Control reported 900 dog-on- dog attacks, a relatively low number considering how many people have dogs. Much of the reason that so few cases involving dog attacks pass through the courts is that, up until recently, dog owners could not be held criminally liable if their dog attacked another animal. Now, the implementation of a new law dubbed Fabian’s Law has come in large part because of one Glendale couple’s desire to seek justice after their poodle was killed by another dog. The new law states that an owner of an aggressive dog or person in care of the dog (i.e. dog sitters, family members, or friends) can now be found guilty of a Class 1 misdemeanor and up to $2,500 in fi nes and six months of jail time if the dog attacks another animal. Owners of an aggressive dog can also be charged with a misdemeanor and held liable for similar penalties even if the dog gets out of the yard or off the leash. So, what constitutes an aggressive dog? Pursuant to the new law, an aggressive dog is de fi ned as any dog that has bitten a person or domestic animal without provocation or that has a known history of attacking people or animals without provocation. An owner of an aggressive dog who has been deemed so as a result of prior incidents or a history of reported aggressive behavior must now take extreme caution or otherwise suffer the legal consequences. Owners of dogs who have never had any previous incidents or whose dogs have no history of aggressive behavior need not be overly concerned. I have two dogs, one chocolate Labrador and one American pit bull, and they are far from aggressive. However, after watching far too many episodes of The Dog Whisperer , I’ve learned that caution is key. We tend to forget that, although domesticated, dogs can still be vicious given the right, or wrong, circumstances. Practice caution and safety with your canines.
